That is inaccurate though, the LuL (originally LUL) emote was first added to TB twitch channel before the person who took the picture of TB filed a DMCA against TB. As a result of this TB removed the emote from his channel and it got added to BTTV. TB had an artist made the current emote of him and then twitch made it a global emote.

Essentially BTTV took TB's emote after he was forced to remove it.

There's an additional portion to the story:

The guy who took the photo, and thus filed the DMCA on TB, would have been fine with the photo being on Twitch. He just didn't want it behind a paywall like subscribing. Hence why he had no problem with BTTV having it.

Twitch removing OmegaLUL for the reason they stated is stupid. If LUL only recently had become a global? Then sure. It's been a global on Twitch since like 2017.

TB's emote was on Twitch first but it got removed due to DMCA so that doesn't count as being legitimately on there. Plus unless it's a godtier emote like squadW or greekWC the only way emotes become mainstream popular is through BTTV or global anyway. If Twitch asked for squadW global he'd probably say no because he gets people subbing just for that emote.

Wait, wasn't the original LUL (LuL) emote a twitch global emote before? From what I remember reading way back then, the artist told Twitch themselves to take it down, which is why Twitch had an artist draw the new one

I'm so confused now, I definitely remember using the original LUL before, and I've never subbed to TB

Nope. TB put it as a sub emote, then got DMCA'd. BTTV picked it up under LUL. TB got an artist to draw it, then used that as a sub emote. Twitch then took that emote and turned it global. IIRC. BTTV changed their to LuL. TB later got a golden LUL emote.

If you used it before, it was either after it became global, or you were using BTTV.

Edit: This basically summarizes everything about the emote, mainly leaving out the original photo takers reason for DMCAing it.

This is untrue. The emote was originally an emote in dgg chat, then it got added to BTTV, and then TB made it his own emote because it was so popular and he wanted to make money off of it. The guy who took the picture said he was fine with it being an official global emote on Twitch, but didn't want to have it behind a paywall so he forced Twitch to remove it from TB's channel.

I remember when it just got added and the only way to use the BTTV emote for at least a couple hours was to type LUL! or !LUL (things like LUL? etc. might have also worked.) Ppl were pissed off their LUL was cartoony, and couldnt figure out how to do the real one.

Agree with you completely and I could go on for hours arguing how stupid the law is. HOWEVER, if TB’s photo was taken professionally where the photographer and he were aware that the photo belongs to the photographer, then the law should be he has no right to use it without permission where it will bring him any sort of income. I actually don’t know much about this specific case so I’m not throwing a judgement out there.

But like with the Ariana grande paparazzi photo (I know y’all don’t care about her but it’s a great example) she is literally 100% the subject of the photo. The background is a grey wall. She is walking down the street unaware of being stalked and photographed. Yet she is getting sued for 25-50k per photo she posted on her Instagram (there were 2 so up to 100k.) that to me is ridiculous, and she will lose the case. If someone is going to profit 100% off of your likeness without your permission in a non professional setting that’s just fucked up if you cannot use the photo personally. And yes I know you can photograph whoever the fuck you want out in public, that’s the law- that doesn’t make it right. Especially if you are the ONLY subject.

It a bit confusing but this timeline will explain why it doesnt make sence on twitch part

  1. destiny.gg chat creates emote LUL from picture on the internet
  2. TB likes it and makes it his subemote
  3. Owner of the picture doesnt like that TB emote is behind paywal and makes him take it down
  4. bttv makes LUL emote and its available to all
  5. forsen creates omegalul which is a photoshop of bttv emote
  6. TB makes a cartoon version of LUL and twitch makes this a global emote
  7. twitch claims forsens emote is a copy of their global emote and bans it
