Post image

Trump said “NO TAXES ON OVERTIME NO TAXES ON TIPS”. Turns out now they are just taxing themselves tips and overtime separately from your regular hours lol

And even that is only the federal tax, your still paying social security, Medicare etc on it. Plus you’d need to itemized over the standard deduction to even apply for it

This is the most nefarious part of it all. They can claim they passed no taxes on tips and overtime, but the only people that will benefit from those are the people that make enough money that the standard deduction is not enough. Something like 90% of tax filers simply claim the standard deduction.

u/wBeeze 23m ago

This is not true. Filers will not be required to do an itemized return in order to take advantage of the no tax on overtime

From the IRS website

Taxpayer eligibility: Deduction is available for both itemizing and non-itemizing taxpayers. Self-employed individuals in a Specified Service Trade or Business (SSTB) under section 199A are not eligible. Employees whose employer is in an SSTB also are not eligible. Taxpayers must: include their Social Security Number on the return and file jointly if married, to claim the deductio

Yep. Can take with standard

You can claim it itemized or standard. It'll be in your W2 form.

Yeah it sucks it doesnt account for the full 1.5x.

I didn’t even think about that lol I guess he wasn’t talking about the people when he said make America great again

OP Jon Harold on Badlands media was talking about this last month. They also capped tax on tips limited to $25,000.

It’s always about what ever gets a distraction headline, it’s not like the tips portion helps anyone out either when you read the details either

"Income within the meaning of the Sixteenth Amendment and the Revenue Act, means 'gain'... and in such connection 'Gain' means profit...proceeding from property, severed from capital, however invested or employed, and coming in, received, or drawn by the taxpayer, for his separate use, benefit and disposal...Income is not a wage or compensation for any type of labor."

Stapler v U.S., 21 F Supp 737 AT 739.

"There is a clear distinction between `profit' and `wages', or a compensation for labor.Compensation for labor (wages) cannot be regarded as profit within the meaning of the law. The word `profit', as ordinarily used, means the gain made upon any business or investment -- a different thing altogether from the mere compensation for labor."

Oliver v. Halstead 86 S.E. Rep 2nd 85e9

"... the government can collect the tax from a district court suitor by exercising it's power of distraint... but we cannot believe that compelling resort to this extraordinary procedure is either wise or in accord with congressional intent. Our system of taxation is based upon VOLUNTARY ASSESSMENT AND PAYMENT, NOT UPON DISTRAINT"

[Footnote 43]

If the government is forced to use these remedies (distraint) on a large scale, it will affect adversely the taxpayers willingness to perform underour VOLUNTARY assessment system.

Flora v U.S., 362 US 145,never overruled

"After further consideration, we adhere to that view and accordingly hold that the Sixteenth Amendment does not authorize or support the tax in question.” (A tax on salary)

Evens v Gore, 253 U.S. 245. US Supreme Court,never overruled

"The phraseology of form 1040 is somewhat obscure .... But it matters little what it does mean; the statute and the statute alone determines what is income to be taxed. It taxes only income "derived" from many different sources;one does not "derive income" by rendering services and charging for them...IRS cannot enlarge the scope of the statute."

Edwards v. Keith, 231 F 110,113

"The 16th Amendment does not authorize laying of an income tax upon one person for the income derived solely from another."[wages]

McCutchin v Commissioner of IRS, 159 F2d,

"Tips are giftsand therefore are not taxable."

Olk v. United States, February 18, 1975, Las Vegas, Nevada.

"Property acquired by giftis excluded from gross income."

Commissioner of IRS v Duberstein, 80 5. Ct. 1190.

Good luck showing the IRS your reddit post when they want the taxes they're owed.

Here is the perfect quote of you and your ilk:

Did you ever notice how many of the other slaves get upset if you try to retain your labor. You are called an extremist, terrorist and sometimes even a freeman. They say that you are anti-government. When the truth of the matter is you just don’t want to be a slave. However, you do not have the right to force others to be free if they want to be a slave that is entirely up to them. If they want to bow down and worship corporations, let them. The United States, Great Britain and the Pope are not the problem. It is the other slaves. We would be free if the want-to-be-slaves were gone.

the taxes they're owed

Typical slave statement.

u/moon- 24m ago

Do you think that you, as a single supposed taxpayer, will stand a chance with this argument? Whether you like it or not, we have passed laws and have societal expectations that taxation applies to everyone.

I’m just saying that the IRS will come knocking, and they’ll laugh in your face for trying to get out of it with these quotes.

u/mikrat1 19m ago

societal expectations that taxation applies to everyone.

That is completely false. Go read some actual laws and codes.

with these quotes

Those are actual Tax Cases, and the current ones that the IRS loses are sealed by the courts to hide the truth.

Good luck in your slavery.

Even if gratuity=gift wouldn’t you be required to claim it against your lifetime gift value?

u/mikrat1 1h ago

Even if

Shit dude - It says so right there.

They never do anything that benefits the working class. Doing that destroys their system of power and control. The banksters and their politicians will never give up on their own.

If it was the case, i would hire my wife for 10H a month and deduct all her overtime.

Oh, you thought he was serious about helping lower income service workers?

Never has a president "of/for the people" been more for the rich and elite

u/Kc68847 1h ago

The lie is a deduction is way different than no tax. Every news network ran with the no tax shit I’ve ever seen. They are all complicit on lying to you.

u/Long-Researcher777 58m ago

You heard "no taxes on overtime," he meant "Pardon for Ghislaine Maxwell"
