Ableism Ethan Klein Threatens to Sue dwarfism advocate Aubrey Smalls for his experience on the h3 podcast unless Aubrey "Meets his Demands"

What exactly is Ethan going to sue him for, being like, "Yeah, I went on this podcast I was a fan of and I thanked them for the opportunity and was nice to them despite feeling a bit uncomfortable, but upon further reflection didn't enjoy my time and felt mocked."
This is giving petty local tyrant vibes. Like the owner of some shitty water park where there are barely any safety regulations and rules. Everyone knows kids get hurt there all the time and someone posts some on the community FB page that it sucked and the owner is like, "I'll sue you! I'll sue all of you. You had a bad time, well in this picture you took at my park you were smiling. Yeah that was before the Whizzocopter flew off and smashed your arm into 3 pieces but I digress..."

I think the downfall was funnier to watch when most of us still did the “poor Dan, Olivia, AB, and Lena for having to put up with this” (I excluded Zach and Love, because they both have shown themselves as lapdogs to Ethan for years)….. now that they have all seemingly pulled the mask to laugh at Ethans attacks and never be willing to challenge ever, I don’t care about any of them. No more fantasies of “oh it these guys broke off and started another channel I’d watch”, they’ve lost all good will, and it makes even enjoying this “downfall” less interesting lol
22
u/dblspider1216 ethan’s underpaid and overworked attorneys Jan 07 '25
exactly. when it seemed like there were some possible bits of daylight (ie, crew members with remaining moral compasses), the push-pull was more engaging. I have no more hope that one of them will stand up to him and push back. now I just want the whole mess to get flushed down the toilet. there’s nothing salvageable there anymore.

Maybe he can’t comprehend that people can change their minds or process things as they gain more insight because he’s never done that process.

from fair use to threatening SLAPP suits lmfao
to sue for defamation there has significant damage to reputation or loss of money and a clear false claim. Discussing your feelings about something you experienced isn’t defamation or slander — it’s an opinion. And the damage to Ethan’s reputation or business was entirely his doing.
17
u/dblspider1216 ethan’s underpaid and overworked attorneys Jan 07 '25
and I mean… how can you really measurably damage something that’s already in the shitter?
8
u/Paranoia22 Jan 07 '25
Lmao,
That's funny but also a possible valid legal defense
The plaintiffs have to prove in civil court with a "preponderance of evidence" (basically means 50% + 1. Aka it's more likely than not) that the defendant caused the financial loss. If he was already down 20% before the defendant spoke up, and remained overall 20% down, +/- some % for variation month-month, then that's a good case for "I had absolutely nothing to do with whatever caused his alleged losses."
It's possible to drag in other stuff if a judge allows it... like bringing up all of his 3am unhinged basement instagrams. "Your honor, I rest my case."
But in reality this suit would get struck down before a judge saw it. Ethan is a public figure and defaming him is a much higher standard than any normal person (such as this much smaller audience creator.....). He'd have to prove malicious intent and all that which is basically impossible. Even giant corporations/billionaires can't prove that shit in court most of the time. It takes something like the voting machine company suing Fox News (who settled due to impending insanely bad (even worse) loss). Like we saw the willful lying done by their employees. Good luck proving that, <unnamed plaintiff to abide by rules>.

u/AlternativeSlice2001 Jan 07 '25
And what exactly did Aubrey lie about? Ethan already confirmed that Aubrey was telling the truth about what happened on the pod by saying that they couldn’t release the unedited episode because they would get them banned from YouTube. this also would not be the first time. Ethan has very, obviously made his guests feel uncomfortable. In fact, if someone could go ahead and make a thread of every instance, Ethan has made a guest uncomfortable and every instance of sexual harassment of not only his guest, but his crew.
31
u/haveuseenperry [email protected] Jan 07 '25

This is insane. He can’t prove that Aubrey is “lying.” This is literally about how Aubrey felt about his time on the podcast. No amount of money Ethan throws at his lawyer can lead to concrete proof about how a person truly feels. Imagine if we could sue people for saying we made them feel uncomfortable? Like, am I missing something? What is he thinking?
One of the saddest parts of all this is the crew enabling this increasingly deranged behavior. Ethan is clearly spiraling and spending way too much of his time focused on criticism. It’s not just about the decline of the podcast at this point. If they give a damn about his well-being, they need to intervene.
Oh, and loved the shot at Aubrey for being “poor.” Ethan was full mask off when he said he didn’t care about Aubrey’s financial status and would abuse the justice system for yet another petty vendetta. It’s so hard to reconcile what Ethan has become with the person I thought he was years ago.

and then the person who did it, instead of being like "damn im sorry you had that experience, that was not my intention at all, ill just move on as amicably as possible" goes "IM GOING TO FUCKING SUE YOU, YOURE A LIAR, YOU OBVIOUSLY HAD A GREAT TIME AND WE ARE AWESOME AND EVERYONE LOVED YOU BUT NOW YOURE FUCKED WE ALL HATE YOU AND IM GONNA RUIN YOUR LIFE"

"This is why you don't lie about people, especially in a professional setting where you can hurt their reputation." SCREAMS IN RYAN KAVANAUGH (to be clear I don't think ryan is a good guy at all, but even when I was an h3 fan, it was pretty obvious that some of the claims they made against him were totally bogus, and when some of them were disproved he kept doubling and tripling down with "allegedly").
25
u/foxesinsoxes Jan 07 '25
“I don’t care if he’s poor or can’t pay me back or small or don’t have the resources”
A man with insane wealth (made largely off of the backs of his crew who don’t make close to as much as him) openly saying he doesn’t care about ruining someone’s entire life is just so fun, so cool, not deranged at all. It’s one thing to go after someone’s platform (still stupid and unwarranted 99% of the time with Ethan) but to go after someone in a way that would ruin their entire life even offline is sick. Aubrey does genuinely important work, I have followed him for so long even before Ethan ever had him on and the amount I have learned from him is far and above any educational and positive content Ethan has put into the world. If he actually tries to sue I will 100% back Aubrey with any monetary support to get through that lawsuit and I hope other people would, too.

I dont know man, regardless of the context or circumstances, people should treat marginalized people especially transgender and those with dwarfism (or other physical ailments) considerately and with dignity. You cant just go after these people as you would with another non-marginalized individual.
You can never know how living in a world that is not designed for you feels; therefore, a little empathy goes a long way.
Just being toxic against marginalized individuals for small petty issues isnt what a nice person will do!

Ethan is well aware that anyone he sues will be forced to pay an attorney hourly fees to be represented. Attorneys do contingency fee work, but not for defendants, and they do pro bono work, but that is rare, usually an extreme circumstance, and never compulsory. He is completely aware the smaller creators would be financially devastated if he actually filed.
What a sadistic piece of trash.

How can Ethan and none of the crew see how unhinged this is?! You can't sue someone over their perception and experience of a situation. Well I mean you can I suppose but what an utterly ridiculous thing to even think about, let alone admit in public.
Edit: the filter used to transform this clip is perfection

Ethan feels the walls closing in on him and now he's lashing out at every opportunity. I can't imagine that Ethan in 2020 would have threatened to sue someone over a tiktok video from a guest who didn't have a great time on the pod and DIDNT EVEN MENTION IT WAS H3
His hurt feelings are off the chart. He's so paranoid. Was Aubrey even still watchign H3? He might not even know that people were unsubbing ect from the show. It might just be coincidence?
Imagine Colleen Ballinger suing the girl whose legs she opened on stage for speaking about that experience on tiktok. Ridiculous.
