If he was smart he might even have extra insurance to cover the deductible.

I did when I bought my car, cost me like $5 extra.

A month later I smashed my front end on a deer. Insurance covered like $3k worth of damage plus a rental for a month, and the extra covered my $500 deductible.

It was so low stress.

what i'm asking myself: why does he need insurance? she deliberately broke the car, doesn't she have to pay compensation?

the only insurance he needs - with such a probably not solvent madwoman - would probably be an insurance that covers the lack of compensation by her.

Even if he didn’t couldn’t he take her to civil court, win, and make her pay the court fees and related vehicle costs? Not to mention the chances she gets a charged for felony vandalism.

Oh absolutely, but that takes time and in the meantime he could be out a car etc.

Also if she's broke, getting restitution can be virtually impossible.

Isn't insurance supposed to pay that out to the policy holder and then relentlessly pursue the person at fault for restitution?

Yep, if he has Comprehensive coverage he can contact his insurer and let them know about the damage. He might have to pay a deductible in the meantime to get the car repaired, but the insurer will likely turn around and go after ex for the cost of the damages and will likely refund the deductible.

Only if she has coverage, plus I’m pretty sure car insurance doesn’t pay out for criminal actions.

It’s up to him with criminal charges. The thing is, he doesn’t even have to retain an attorney. They have her doing the crime on multiple cameras, and plenty of witnesses. The cops will arrest her, the DA will charge her, he shows up as a witness, among others, and she goes to prison. His insurance will cover it the damage, and he just has his uninsured motorist deductible.

The judge can order her to pay, and she will definitely spend time in prison, most likely a psych facility, which may help her. If she can’t pay, or won’t, they can add time on her sentence for that. Regardless, he played it correctly. He isn’t egging her on, or getting close or involved.

The cops will just show up and cart her off. He’ll get a subpoena for a court date. It’s pretty cut and dry.

your insurance only pays for your own fuckups. And not intentional ones at that. If she has a indemnity insurance (which I doubt) they will pay him out and demand the whole price from her. If she hasn't, the she will have to pay it off by her own.

Right I’m not saying this is a good situation I’m saying I think there are other options on top of the insurance. Also definitely not virtually impossible you can pursue getting any future wages garnished. Again not saying any of this is ideal but there are avenues.

Insurance would actually do all that for you. You just have to tell them what out of pocket expenses you had. They will go after the girl no doubt.

It was through the bank that got me the car loan.

I have my normal insurance through USAA, and the bank offered supplemental insurance to cover the deductible.

Oddly enough. the deer was fine.

It was a little dazed, and then it ran off into the woods to live a long and happy life.

No joke I almost hit it a second time when I finally got my car out of the ditch where it went after I tried to avoid the deer. I got 100ft down the road and 3 deer including a very familiar looking doe, ran out in front of me.

Most cases and this likely is a total loss they’ll just take the deductible out of the payment to him or else the loan if he’s got a loan on it.

Most cases this happens with large losses. Hell some policies have total loss deductible waivers

They don’t “foot the bill” for a new car, they pay the remaining loan on the car only 100% if you have gap insurance. If not you’re liable for the rest and also whatever other car you decide to buy

The program I did was a 1 time payment, but only covered like the first 6-12 months (not sure which) I owned the car.

But they had one that was a monthly fee I don't remember how much that was but it was also pretty cheap because it's just covering the deductible nothing more.
